Simplaful ("we," "our," or "us") is operated by Show 4 Reel Media Pty Ltd (New South Wales, Australia) and provides web applications under the Simplaful platform. By creating a Simplaful account or using any Simplaful product, you agree to these Terms.
1. Your Simplaful Account
A single Simplaful account gives you access to all Simplaful products at the free tier. Paid features within each product require a separate subscription for that product.
You agree to:
- Provide accurate and complete information when registering
- Keep your password secure and confidential
- Accept responsibility for all activity under your account
Notify us immediately at hello@simplaful.com if you suspect unauthorised access.
2. Acceptable Use
You may use the Services only for lawful purposes. You may not:
- Violate any applicable law or regulation
- Attempt to gain unauthorised access to the Services or another user's account
- Interfere with or disrupt the Services or connected infrastructure
- Use automated bots or scrapers without written permission
- Reproduce, resell, or exploit any part of the Services without written consent
- Impersonate any person or entity
3. Subscriptions and Payments
Free plans: All Simplaful products offer a free tier with feature limitations described within each product.
Paid subscriptions: Unlock premium features within a specific product. Pricing is shown within each product at the time of purchase.
Billing: Subscriptions are billed in advance, annually or monthly as specified. Payment is processed by Stripe. By subscribing, you authorise us to charge your payment method on each renewal date.
Renewal: Subscriptions renew automatically. You will receive a reminder before renewal. Cancel any time via account settings or the Stripe Customer Portal.
Cancellation: Cancellation takes effect at the end of the current billing period. You retain access to paid features until the period ends. Cancelling one product does not affect subscriptions to other Simplaful products.
Refunds: A 14-day refund window applies from the date of initial purchase. Contact hello@simplaful.com within 14 days for a full refund. After 14 days, payments are non-refundable except where required by law.
4. Your Data
You retain full ownership of all data you input into any Simplaful product. We claim no rights to your content beyond what is necessary to operate the Services. We do not sell your data or use it for advertising. You may export your data at any time.
5. Intellectual Property
The Simplaful platform, software, design, and trademarks are owned by Show 4 Reel Media Pty Ltd. You may not copy, modify, or reverse-engineer any part of the Services without written permission.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant uninterrupted or error-free operation. You are responsible for verifying the accuracy of all data and outputs from the Services.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMPLAFUL'S LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING ANY CLAIM, OR AUD $100, WHICHEVER IS GREATER. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE EXCLUDED UNDER AUSTRALIAN CONSUMER LAW.
8. Australian Consumer Law
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a refund or replacement for a major failure and compensation for any other reasonably foreseeable loss.
9. Termination
You may delete your account at any time from account settings. We may suspend or terminate accounts that materially breach these Terms. Your data will be deleted within 30 days of account deletion.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the jurisdiction of the courts of New South Wales.
11. Changes to These Terms
We will notify you of material changes by email and by updating the date above. Continued use after changes constitutes acceptance.
